Using this site
These Terms & Conditions (“Terms”) are a legal agreement between you and Tech Avenue (“Tech Avenue”, “we”, “us”, “our”). They apply whenever you use thetechavenue.shop (the “Site”) or buy from us. Our Privacy Policy, Shipping Policy and Refund & Returns Policy are part of these Terms. By using the Site or placing an order, you agree to all of them. If you do not agree, please do not use the Site.
Who may buy
You must be at least 18, or the age of majority where you live, and able to form a binding contract. We sell to customers with delivery addresses in the United States, for personal and household use. We may decline orders that appear to be for resale.
Accounts
You can check out as a guest or create an account. Account holders must provide accurate information, keep their password private and tell us promptly about any unauthorized use. You are responsible for activity on your account, and we may suspend or close accounts used in breach of these Terms.
Product information and compatibility
We describe our products as accurately as we can, including memory, storage, output resolution and refresh rates, wireless frequency and range, camera and app features, heat settings and included attachments. Product photos are for illustration, and on-screen content shown in images is simulated.
Some products depend on your own equipment or accounts:
- Handheld game consoles run the Android operating system. Games and apps are obtained from third-party stores and developers, may require an account and an internet connection, and are not part of your purchase from us unless the product page says they are included. You must only install games and apps you are licensed to use, and compatibility varies from title to title.
- Smart telescopes are set up and operated through a companion app provided by a third party, which must support your phone or tablet.
- Wireless intercom headsets have a working range that varies with walls, metal structures and other 2.4GHz devices nearby.
You are responsible for checking compatibility before ordering. We will confirm it in writing if you send us the details first. If a product you receive does not match its description, the Refund & Returns Policy explains your remedy.
Prices and taxes
Prices are in US dollars and may change at any time, but a change does not affect an order we have already accepted. Sales tax is calculated at checkout from your delivery address where the law requires it, and any shipping charge is shown before you pay. If a product is listed at an obviously wrong price, we may cancel the order and refund you in full, even after sending an order acknowledgement. We will tell you before cancelling.
How your order becomes a contract
When you place an order you are offering to buy. Our first email only confirms that we received the order. The contract is formed when we email you to say the order has shipped. Until then we may decline or cancel all or part of an order, for example if an item is unavailable, if payment or delivery details cannot be verified, or if we suspect fraud. If we cancel after taking payment, we refund the full amount to your original payment method.
You may cancel free of charge at any time before your order ships by contacting us. After it ships, our Refund & Returns Policy applies.
Payment
Payment is taken at checkout by our payment processor. By entering payment details, you confirm you are authorized to use that payment method. Your card issuer may show a temporary authorization, which it releases if it does not become a charge, usually within a few business days.
Delivery, ownership and risk
Delivery is governed by our Shipping Policy, and delivery dates are estimates. Ownership of an item passes to you once we receive full payment. Risk of loss or damage passes to you when the item is delivered to your delivery address.
Returns and warranty
You may return eligible items within 30 days of delivery under our Refund & Returns Policy. Every product carries a 12-month limited warranty against defects in materials and workmanship, described in that policy. Except for that warranty and any warranty that cannot be excluded by law, products are sold without other express warranties. To the extent the law allows, implied warranties of merchantability and fitness for a particular purpose are limited to the length of the limited warranty. Some states do not allow limits on implied warranties, so this limit may not apply to you. These returns and warranty rights are in addition to your rights under consumer protection law.
Safe use
Always follow the instructions and safety warnings supplied with each product. In particular:
- Handheld consoles and other battery-powered products. Charge only with the supplied charger or a correctly rated one, do not leave devices charging on soft surfaces or in hot cars, and stop using any device whose battery swells, overheats or is damaged.
- Smart telescopes. Never point a telescope at or near the Sun unless a certified solar filter designed for that telescope is fitted correctly. Doing so can cause permanent eye injury to anyone looking through an eyepiece or near the device and will damage the camera sensor.
- Air stylers and straighteners. These tools get very hot. Keep them away from water, children and flammable surfaces, let them cool before storing, and use them only on a correctly rated US power outlet.
- Headsets. Set listening volume to a safe level and stay aware of your surroundings when wearing a headset in a work environment.
Tech Avenue is not responsible for damage or injury caused by installation, use or storage that goes against the product’s instructions or these warnings.
Acceptable use of the Site
You agree not to:
- use the Site unlawfully or in breach of these Terms;
- try to gain unauthorized access to the Site, its servers or any account;
- upload malware or interfere with the Site’s operation or security;
- scrape or collect content or data from the Site by automated means without our written permission;
- provide false information, impersonate someone else or pay with a method you are not authorized to use.
Intellectual property
The Site’s content, including text, graphics, page designs, original photographs and the Tech Avenue name and logo, belongs to Tech Avenue or its licensors and is protected by law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission. Other product and platform names that appear on the Site belong to their respective owners, and their use does not imply endorsement.
Third-party services and links
Some products rely on apps, platforms and online services run by other companies, and the Site may link to other websites such as carrier tracking pages. We do not control those services or sites and are not responsible for their availability, content, fees or privacy practices.
Limitation of liability
Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, or for fraud. Otherwise, and to the fullest extent the law allows, Tech Avenue is not liable for indirect, incidental, special or consequential losses, including lost data, lost profits, lost game progress or loss of use, arising from your use of the Site or any product. Our total liability for any claim relating to an order is limited to the amount you paid for the product that gave rise to the claim.
Indemnity
To the extent the law allows, you agree to indemnify Tech Avenue against claims, losses and reasonable costs arising from your breach of these Terms or misuse of the Site.
Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, carrier disruptions, power or internet outages, labor disputes, government action or public health emergencies. We will tell you if such an event affects your order and, if we cannot deliver, refund you in full.
Governing law and disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. If you have a concern, please contact us first so we can try to resolve it informally. Any dispute that cannot be resolved that way will be heard by the state or federal courts located in the State of Georgia, and both you and Tech Avenue consent to their jurisdiction. This does not prevent you from bringing a claim in the small claims court where you live or from using the consumer protection laws of your state.
General
If any part of these Terms is found unenforceable, the rest remains in force. Not enforcing a right does not waive it. These Terms and the policies they include are the entire agreement between you and us about the Site and your purchases. We may update these Terms, and the version in force when you place an order applies to that order.
